Feds Win Right to War Protesters' Records

DES MOINES, Iowa (AP) - In what may be the first subpoena of its kind since the Communist- hunting days of the 1950s, a federal judge has ordered a university to turn over records about a gathering of anti-war activists.

In addition to the subpoena of Drake University, subpoenas were served this past week on four of the activists who attended a Nov. 15 forum at the school, ordering them to appear before a grand jury Tuesday, the protesters said.

Federal prosecutors refuse to comment on the subpoenas, served by a local sheriff's deputy who works on the FBI Joint Terrorism Task Force.

In addition to records about who attended the forum, the subpoena orders the university to divulge all records relating to the local chapter of the National Lawyer's Guild, a New York-based legal activist organization that sponsored the forum.


The group, once targeted for alleged ties to communism in the 1950s, announced Friday it will ask a federal court to quash the subpoena on Monday.

"The law is clear that the use of the grand jury to investigate protected political activities or to intimidate protesters exceeds its authority," guild President Michael Ayers said in a statement.

Representatives of the Lawyer's Guild and the American Civil Liberties Union said they had not heard of such a subpoena being served on any U.S. university in decades.

Those served subpoenas include the leader of the Catholic Peace Ministry, the former coordinator of the Iowa Peace Network, a member of the Catholic Worker House, and an anti-war activist who visited Iraq in 2002.

They say the subpoenas are intended to stifle dissent.

"This is exactly what people feared would happen," said Brian Terrell of the peace ministry, one of those subpoenaed. "The civil liberties of everyone in this country are in danger. How we handle that here in Iowa is very important on how things are going to happen in this country from now on."

The forum, titled "Stop the Occupation! Bring the Iowa Guard Home!" came the day before 12 protesters were arrested at an anti-war rally at Iowa National Guard headquarters in Johnston. Organizers say the forum included nonviolence training for people planning to demonstrate.

The targets of the subpoenas believe investigators are trying to link them to an incident that occurred during the rally. A Grinnell College librarian was charged with misdemeanor assault on a peace officer; she has pleaded innocent, saying she simply went limp and resisted arrest.

"The best approach is not to speculate and see what we learn on Tuesday" when the four testify, said Ben Stone, executive director of the Iowa Civil Liberties Union, which is representing one of the protesters. Supporters plan to demonstrate outside the courthouse.

Mark Smith, a lobbyist for the Washington-based American Association of University Professors, said he had not heard of any similar case of a U.S. university being subpoenaed for such records.

He said the case brings back fears of the "red squads" of the 1950s and campus clampdowns on Vietnam War protesters.

According to a copy obtained by The Associated Press, the Drake subpoena asks for records of the request for a meeting room, "all documents indicating the purpose and intended participants in the meeting, and all documents or recordings which would identify persons that actually attended the meeting."

It also asks for campus security records "reflecting any observations made of the Nov. 15, 2003, meeting, including any records of persons in charge or control of the meeting, and any records of attendees of the meeting."

Several officials of Drake, a private university with about 5,000 students, refused to comment. A source with knowledge of the investigation said a judge had issued a gag order forbidding them from discussing the subpoena.

bring it on! It is amazing that all these wannabe despots try to hide behind patriotism when their friends and Vice Presidents get caught with their hands in the cookie jar. If any Grand Jury gets called it should be to investigate the charges of bribery leveled at Dick Cheney.

And while you are pulling records, you had best pull mine too, because I have no use for either you or your stinkin' war.

Thanks admin! I think It is very important to get this kind of info out to everyone. Those that have the ability to think for themselves should find this type of tyranny unacceptable.
Those that just follow blindly will always be an obstacle for those of us that pay attention, but the more people that realize the truth of what is happening the better.:cool:

I have to question the intelligence of anyone that thinks this type of government incursion on our rights is OK.:cool:

If you remember, Joe McCarthy never had a bit of proof on anyone he accused of being a Communist Shinobi. The guy would just go on television and accuse someone and the press would then hound them out of the country. The House on Un-American Activities was no better than McCarthy and all of a sudden there was a Communist behind every mailbox. This is how it starts, a bit of panic and the Nazi's in the government take it from there.

That right has been subverted ever since that cross dressing Director of the FBI figured he could use illegally gathered information as blackmail to further his own agenda Dragon. There has never been any accountability at FeBI and I doubt there ever will be. Now they have another excuse to trample on civil rights and they durn sure are going to exploit it.

I understand the FBI used the information gained from those private and personal records to further the "public good". It seems they started paying personal visits to the folks on those lists and "cautioned" them against being in New York during the Republican Convention and "strongly cautioned" them against protesting in any way, shape or form. I am certainly glad the FBI is out in the field protecting this country against the demon protesters.

I saw a report on girl in Boulder or Denver that recieved such a visit. She was questioned,(harrassed), because the FBI had learned she was going to NY to protest. The agent repeatedly asked her and her roomies, if they planned on doing anything illegal while they were in NY.????? Like, if they were to be planning something illegal, they'd tell him???

Aren't FBI agents supposed to be intelligent?

Bushy Buddy and all his loyal minions are now making the charge that Kerry is a traitor for giving testimony under oath to a Senate Committee looking into the war in Southeast Asia that Johnson lied us into. To top that off, Bushy Buddy is also saying that any critism of his conduct of the war that he lied us into is "giving aid and comfort to the enemy". What rock did Bushy Buddy crawl out from under anyway?

George W. Bush lied to the American public about the reasons for going to Iraq! HE LIED!!! It is documented. A PROVEN FACT! GEORGE W. BUSH, LIED TO US, and now we have over 1000 service men and women to mourn for!

I cannot believe that Bush is ahead in the polls. How can this happen? How stupid, really stupid can these people be to want four more years of this son of a Bush?

It's truly amazing, isn't it? But people are stupid Shinobi. They believe what the TV tells them to believe. Nobody questions authority anymore. Nobody asks the tough questions because by doing so, they would have to admit to their easy programbility.

Consider this.....
NBC ran a story today stating that the Soccer Mom has now morphed into the Security Mom. The "soccer mom" is overwhelmingly supporting George Bush because they feel he is more apt to win the war on terror! lol! I nearly fell out of my chair when I heard that. Have we forgotten that IRAQ DID NOT HAVE ANY WMD AND DID NOT HAVE ANY PROVEN CONNECTION TO THE WTC??!!! What is this war on terror we are fighting? If we are truly fighting a war on terror, why are we so focused on IRAQ????

As for the Kerry flip-flop issue.....
Amazing what the spinsters do. They say Kerry flip flopped on the war on Iraq. He sure did. I bet he would be the first to tell you if you would listen as to WHY he changed his mind. How soon we forget that the original vote to invade Iraq was based on FALSE INFORMATION. After realizing this, would you in good faith continue to vote for a war that you had been lied to about?

Lord help us all. Bush will destroy this country in another 4 years.

Also, we keep getting inundated with all the "beneficial" bills that Kerry has voted against. I researched this somewhat and found that the bills in question had unacceptable (to Kerry) "riders" attached that had nothing to do with the original bills. These are why Kerry voted against them. I'm sure if he had voted for them, Dub would be telling everyone that Kerry had helped pass this rider or that one.

Every time I see that numbskull Dub making a point by thrusting his stupid grinning head forward and sticking his hand out, I just want to puke. I can't wait 'til Thursday and the debate when the idjit will fall flat on his big Texan ( I know, he's not really a Texan) grin and flip flops into history. :cool:

I agree with you Shinobi about the debates. I just hope the moderators, Jim Lehrer, Charles Gibson and the other (sorry can't remember his name) don't get stuck on one issue. I understand that each debate is to be about a different issue - the first one dealing with foreign policies, the second dealing with domestic and the third a "town hall" type - not sure if it's going to be a round robin or what.

The current affairs in the US are truely turning to 1984, thought police, double speak and the like. IF it gets to the point where books are being burned.... OY VEY!!! Oh that's right we're at the point of banning books that MAY invoke independent thought!!!!!
